e all make mistakes, but avoidable legal
mistakes can be costly and difficult to
resolve. Knowing about these common mistakes
is the key to avoiding them.
Forgetting to make a will. Without
a will, you could leave your survivors with a
costly legal mess to clean up. Surveys show
three main reasons why people don’t make a
will: procrastination, the belief that they don’t
need one, and cost.
Signing a contract without an
attorney’s review. Lawyers cannot change
the past; never sign a contract, lease or other
agreement before consulting an attorney
for review and advice. Contracts and other
agreements are sometimes written to intentionally
Missing a statute-of-limitation
deadline. Statutes of limitation are laws
requiring an injured or aggrieved party to file a
lawsuit within a certain time frame or lose the
right to sue forever. The length of time to sue
varies based upon the claim, type of injury,
potential defendant and other factors. Nearly all
claims are subject to statutes of limitation, and
some may be less than a year.
A legal service plan can help with all sorts of
planned and unplanned legal issues. LegalShield
is a prepaid legal plan that MTA members may
join for $15.95 a month. As a LegalShield member,
you can rest assured that whether you’re facing
a legal issue that’s big, small or somewhere in
between, you’ll have access to legal advice and
services when you need them.
LegalShield membership covers the member;
the member’s spouse; never-married dependent
children of the member or the member’s
spouse who are under 21 and living at home;
children under age 18 for whom the member or
member’s spouse is the legal guardian; full-time,
never-married students under age 23 if the
student is a dependent of the member or the
member’s spouse; and any dependent child,
regardless of age, who is incapable of sustaining
employment because of mental or physical
disability and who is chiefly dependent on the
member or member’s spouse for support.
Here’s how a LegalShield
membership can help
Will preparation. The process starts with
completing the LegalShield will questionnaire,
which is available via the LegalShield app
(you’ll find downloads for Apple and Android
devices). You may also obtain a will questionnaire
by calling LegalShield. Your provider law firm
information can be located on your LegalShield
mobile app or through the “Ask Erin” feature at
www.legalshield.com. The questionnaire asks
for information about your situation and your
intentions. Once your questionnaire is received,
your provider attorney will draft your will.
Contract review. Your LegalShield attorney
can help you make sense of a contract, lease
or other agreement to ensure that you fully
understand your obligations. Reviewing contracts
and documents of up to 10 pages each is included
in the cost of a LegalShield membership.
Filing a lawsuit. When a potential claim
arises, the first step is to call your LegalShield
provider law firm. You will need to speak with
an attorney and provide necessary information
to determine the statutes of limitation that may
apply to your case. After the appropriate statutes
are determined, and if you decide to proceed with
a claim, an attorney may need several months
to prepare the case for filing. It is essential to
act quickly to protect your legal rights.
If you have any questions about a legal matter, call your
LegalShield provider law firm right away.
